1. About these terms
The website magpietech.us and the MAGPIE online store (the "Store") are operated by Magpie Industry Inc., a Delaware corporation ("MAGPIE", "we", "us" or "our"). These Terms of Service ("Terms") govern your use of the Store and any purchase you make from it.
By using the Store or placing an order, you agree to these Terms and to the policies they refer to, including our Shipping Policy, Return & Refund Policy, Warranty and Privacy Policy. If you do not agree, please do not use the Store.
2. Using the store
You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please tell us promptly at info@magpietech.us if you believe your account has been used without your permission.
We may suspend or close an account, or refuse service, if we reasonably believe it is being used in breach of these Terms or for fraud.
3. Products and pricing
We work to describe our products, specifications and prices accurately. Colors and details may look slightly different depending on your screen, and specifications may change as we improve our products.
Prices are shown in US dollars and do not include sales tax, which is calculated at checkout where applicable. We may change prices, discounts and product availability at any time. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel the affected order and refund any payment you made.
4. Orders and payment
Your order is an offer to buy. We accept it when we ship the product. We send an order confirmation email after you place an order, and a shipping confirmation when it ships. We may limit quantities or cancel an order, for example when a product is out of stock, when we suspect fraud or resale, or when we cannot verify payment. If we cancel an order after you have paid, we refund you in full.
Payment is processed at checkout through Shopify and the payment providers shown there. We do not store your full card number. By submitting payment, you confirm that you are authorized to use the payment method.
5. Shipping
Shipping is free on US orders over $30. Orders ship within 1–2 business days, and delivery typically takes 3–10 business days. Delivery dates are estimates and are not guaranteed. See our Shipping Policy for details.
6. Returns and refunds
You can return a product in new condition, in its original packaging, within 30 days of delivery. For change-of-mind returns, we provide a prepaid return label and deduct a flat $10 return shipping fee from your refund. Returns for a manufacturing defect are free. 7. Warranty
Products purchased from the Store come with a 1-year limited warranty against defects in materials and workmanship, as described on our Warranty page.
Except for that limited warranty, and to the fullest extent permitted by law, the Store and our products are provided "as is" and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow these limitations, so they may not apply to you, and you may have additional rights under the law of your state.
8. Product safety
MAGPIE tools use laser light. Read the user manual before use, and never look into the beam or point it at anyone's eyes, including through optical instruments. Keep tools away from children. Measurements depend on conditions such as surface, lighting and distance, so check critical measurements before relying on them.
9. Intellectual property
The Store and its content, including text, images, videos, logos, product names and designs, are owned by MAGPIE or its licensors and are protected by intellectual property laws. You may view and share Store pages for personal, non-commercial use. You may not copy, modify, distribute or use our content for commercial purposes without our written permission.
10. Reviews and feedback
If you post a review or send us comments or ideas, you confirm that the content is your own, accurate and lawful. You give us a non-exclusive, royalty-free, worldwide license to use, display and share that content in connection with our products and the Store. We may remove content that is misleading, offensive or unrelated to our products.
11. Prohibited uses
You agree not to:
- use the Store for any unlawful or fraudulent purpose;
- provide false information or use someone else's payment method without permission;
- interfere with the security or operation of the Store, including through malware, scraping or automated ordering;
- infringe the rights of MAGPIE or others.
12. Third-party services
The Store runs on Shopify and uses other third-party services, such as payment providers, shipping carriers and customer support tools. Links to third-party websites are provided for convenience. We are not responsible for third-party content or practices, and your use of those services may be subject to their own terms.
13. Disclaimers and limitation of liability
To the fullest extent permitted by law, MAGPIE and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from your use of the Store or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless MAGPIE and its affiliates, officers, employees and suppliers from any claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Store or our products.
15. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. If any part of these Terms is found unenforceable, the rest will remain in effect.
16. Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply to orders placed after they are posted.
